1. Acceptance of Terms

By accessing or using XYLEEZ ("Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and XYLEEZ regarding your use of the Platform.

2. Eligibility and Age Requirements

You must be at least 18 years old (or the age of majority in your jurisdiction) to access, use, or register for the Platform. By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• All information you provide is accurate and complete
• You will comply with all applicable laws and regulations

We reserve the right to terminate any account found to be in violation of age requirements and may report such violations to appropriate authorities.

3. Account Registration and Security

To access certain features, you must register an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for extended periods.

4. Creator Terms

Creators who upload modeling content to the Platform agree to the following:

• All content uploaded must be original or properly licensed
• You retain ownership of your content but grant us a license to host and display it
• You are solely responsible for the content you create and share
• You must verify your identity and age before earning payouts
• Platform fees and revenue splits are as displayed in your dashboard

5. Prohibited Content and Conduct

The following is strictly prohibited on the Platform:

• Content depicting minors inappropriately or child sexual abuse material (CSAM)
• Non-consensual content or "revenge porn"
• Explicit sexual content, bestiality, or extreme violence
• Illegal drugs or weapons
• Content that infringes on intellectual property rights
• Harassment, hate speech, or discrimination
• Fraudulent schemes or scams
• Malware, phishing, or hacking attempts

We reserve the right to remove any content and suspend accounts violating these prohibitions without notice.

6. Payments and Credits

The Platform uses a credit-based system for transactions:

• Credits are non-refundable except where required by law
• Creator earnings are subject to platform fees as displayed
• Payouts require identity verification and are processed according to our schedule
• We reserve the right to reverse fraudulent transactions

7. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, please submit a DMCA notice to our designated agent with:

• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury
• Your physical or electronic signature

8. Creator Non-Compete Covenant

As a condition of registering as a Creator on the Platform, you agree to the following non-compete obligations:

• You shall not create, develop, operate, own, or participate in any platform, website, application, or service that copies, mimics, reproduces, or competes with the XYLEEZ platform concept, business model, proprietary features, or functionality
• This includes but is not limited to fan-subscription platforms, content monetization services, or creator economy platforms with similar features
• This obligation remains in effect during your use of the Platform and for a period of two (2) years following termination of your creator account
• Violation of this covenant may result in immediate account termination, forfeiture of any pending payouts, and legal action for breach of contract
• By registering as a creator, you acknowledge that XYLEEZ's platform concept, features, and business model constitute valuable proprietary assets

9. Termination

We may suspend or terminate your account at any time for violations of these Terms. Upon termination:

• Your right to use the Platform ceases immediately
• Outstanding creator payouts may be forfeited depending on violation severity
• We may retain certain data as required by law

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT CONTENT IS ACCURATE OR APPROPRIATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

12. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the Platform operates, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
